Defection: Court orders fresh summon on 5 governors

A Federal High Court in Abuja on Friday grant­ed the request by the People’s Democratic Party (PDP), to serve its originating summons to the five defected gover­nors through substituted means by publishing it in two national dailies.

This followed an ap­plication filed on June 26, 2014 in pursuant to order 6 rule 5 (c) of the Federal High Court with one prayer based on seven grounds supported by 12 para­graphs affidavit deposed to by Friday Izinyon.

The judge said “I am satisfied that the plaintiff/ applicant has disclosed good reasons to warrant the granting of the application. And it is hereby granted as prayed, the applicant shall within seven days publish the suit in the ThisDay Newspapers or Guardian Newspapers. They would be entitled to 30 days to respond. The case is ad­journed till Sept 22, 2014 for mention.

The Federal High Court in Abuja yesterday ruled that five defected gover­nors from Peoples Demo­cratic Party (PDP),to All Progressives Congress (APC) have not been served with court processes praying it to declare their seats vacant.

PDP filed the legal ac­tion in December last year following the defection of Governor AbdulFatah Ahmed of Kwara State, Governor Rotimi Chibuike Amaechi of Rivers State, Governor Muritala Nyako of Adamawa State, Gov­ernor Aliyu Magatakarda Wamakko of Sokoto State and Governor Rabiu Musa Kwankwaso of Kano state to APC.
